I would ask at the police department. I would not go in with an attitude though. I am sure that you are upset with them but they received a report and they had to follow up on it. They had to use every means necessary to protect your child and rightly so. If you want to go after the person that filed the false claim you should be able to do that through the police department.

I always thought you can charge people for false allegations, talk to the Cops about it.
At least in Texas, it is criminal to KNOWINGLY file a false report. Operative word is knowingly, and that is the hard part to prove. Usually, reports are protected for that reason.. that no one can guarantee if they suspect something (although I think they should). Yes, most places you have the right to copy of the report, but with the reporting person ';blacked'; out.
Having said that... to the best of my knowledge, cps (family services) are the ones who have to file any charges. On the assumption that ALL the evidence showed that it really was bogus, ask for a meeting with cps, and explain your position. That meeting, plus the current record, may go a long way to preventing more issues down the road.

Me and my friend were in a local deli store when there was a big comotion. We went outside and found out somebody stole beers and ran, the owners yelled for help for the cops, the cops came as we were leaving the area and the owners pointed at us saying it was us. The cops cuffed us no questions asked and we sat in a cell for 24hrs getting charged with petit larceny and possesion of stolen property. The camera shows us going to the front counter asking for a price on an energy drink and then walking out. The cops refused to watch or get the video tape. I even encouraged all people of color to get into politics and learn how to fight for their different races' issues. Remember that education helps you deal with racial issues and you are also listened to more when you use educated words and tactics. You can win, but do it diplomatically. Second, if the attorney's false affidavit or failure to file a written statement on time caused you to lose your case, you may have a malpractice action against your lawyer. You'll just have to prove that you would have won your case if your attorney had acted correctly and he will have to pay to compensate you for any losses you caused (including the amount you would have won in the initial case).
If his slip-ups didn't cause you any damages you won't be able to recover anything. You can still point out his perjury to the court and inform the local bar association about it. The bar will investigate, and should sanction him in some way. A friend of mines applied for a California State Police job. Everything was almost a go and his recruiter called him and said that there is a rape charge on his record. He was floored. He almost had a stroke. My friend works for a police department in nj. Just graduated from college with a degree in CJ. Clean as a whistle. Not even a speeding ticket. He never even knew that he was suspect. The girl engaged in a ';train'; with him and some frat brothers. She is known as the campus S**T. Anyway he never went to court. He was never questioned. Never been contacted by the police. NOTHING! They said the girl went and dropped the charges....but its still showing up on his background. Which is weird because he was never charged with anything. He even just renewed his passport. One of his frat bro's just got into med school. They have to run a background check before you can be accepted into med school. Anyway what should he do. I just recently paid my rent online, but the next day, I realized that I had forgotten to pay the processing fee that goes along with that. In order to pay this fee, I wrote a check to my apartment complex for $7 to make up for this faux pas on my part. When I went to check my balance online, I saw that I had a $35 non-sufficient funds charge assessed to my account. To see why, I checked my messages and saw that the check I had written to my apartment complex was not processed for $7 but for $415 (which is what my rent is). Now, in my account history, the online payment for $415 to my apartment complex had alredy been assessed, leaving me with more than enough to pay the $7 check, but instead of this, I got the $35 penalty charge and a bounced check. Now, when this bounced check gets back to my apartment complex, I'll be charge $50 in another fee, and they'll probably try to charge me late fees as well. All of these fees and charges total almost $200 that I do not wish to be wrongly charged for. How do I go about fixing this? 3 months pregnant and about 2 weeks ago I went to have my HIV screening down, which apparently came back positive so my doctor sent my blood work to another lab to confirm with the West Blot test that I did indeed have HIV and the this lab also sent back a positive result, so my dr informed me I did have HIV, my husband ended up getting tested and I went and got my CD4 counts, on the same day which was about 4 days ago my husbands results and my cd4 counts came back, he was negative and my cd4 counts were normal, after this my ob/gyn wanted answers to what was going on and found out the the lab never retested my blood and just sent out a positive without retesting my blood and also found out I was not the only persons blood they did not retest, so after my dr did some calling they retested my blood with the West Blot test and I do NOT have HIV. There are many things that can cause a false positive diagnosis, and being pregnant is one of them. The fact that they did not re-test untill you persisted shows negligence. I believe you do have a case and should sue.

Both born on a Sunday
Both delivered by the same midwife (who was randomly on duty, not chosen by us)
Both were delivered in the same labour room!
Both around the same size, 8lb2oz and 8lb10oz
Both around the same length, 54 %26amp; 55 cm
Both had the same head size

I was induced with my first and went naturally with my second. They were incredibly similar........same duration of labor and pushing (12 hours for each) although with my second, I was very energetic immediately whereas it took me a little longer to pep up with the first.
Thankfully, it was very true in my case. Both were sort of induced (not pitocin but cervidil started the labor the first time and prostagel started it the second time. The good part is that the second was only 3 hours long whereas the first was approx. 24 hours!
mines were totally different. but my girl was defenately better than my boy... even now she is 6 months old, she is better beahved than he was.

My first I had an epidural, had my water broken artificially, got an episiotomy, and was in labour for 13 hours. With my second, I went drug free, waters broke naturally, had a second degree tear, and was in labour for 5 hours.
I'd say my labours were nearly the same. It was the recoveries that were very different.
I went into labour at 7:30am with my daughter, 3am with my son.
Labour started on a Sunday with my daughter, Monday with my son.
Both were born on the same day I went into labour.
Labour lasted 8h55m with my daughter, 6h15m with my son.
About 15-20 minutes of pushing for each.
Epidural with my daughter, no drugs with my son.
86 stitches and 4 months of recovery with my daughter, 7 stitches and 3 hours of recovery with my son.

You need to file a Non Cognisable statement at your local police station just informing them that your wife has left you and that you have never harassed her. You must also add in it that if she tries to file any false complain against you or your family, the case should not be registered without your side being heard.

It's not normal for a judge to remove a child from it's mother just on accusations. Courts can only rule on facts, evidence etc. if you truly feel the judgement is on accusations and not facts and evidence, you should have no problem obtaining an appeal. This is a state of being in a state between sleeping a full wakefulness. People who have experienced this frequently described a floating sensation, being examined by 'horrible creatures' and such.

A local newspaper reported a false story involving my home and my friends truck. The reporters got their information from a nosy neighbor accross the street that had no clue what was really going on.
Now my home, my children and a serious false story was printed for all to know in the town I live in. This paper reprints their stories in their affiliate news station and in 2 sourounding counties.
There are several other issues involved in the endangerment this paper has put my family in.
So what actions do I need to take and where can I find the right lawyer to sue the papers? also, what classification would this law suit be filed under, and can I include the neighbor in a slander suit?What type of lawyer handles a case involving false reports in a newspaper.?VERY IMPORTANT!!!!!!?

Unless you can prove that the false report was printed maliciously, about all you'll get is an apology. You see, libel has to be both false and intended to harm, not merely false. As for your neighbor, he's allowed to have an opinion, even if it's wrong. Only if you could demonstrate that your neighbor knowingly and maliciously (there's that word again), made false statements about you to harm your reputation or financial prospects would you have a case worth pursuing.

Now I'm not much of a lawyer but my mom is, however she's a divorce attorney so she isn't 100% positive on the answer of my question. Now I've read a lot of cases about people who sue companies for millions of dollars for really stupid things. And a couple of weeks ago in my Social Actions class we were discussing false advertisement and we talked about how everything has to be sold exactly how it is advertised or it is false advertisement.
So that same day I saw a Burger King commercial and I thought it was pretty funny, it was the one with the whopper jr and his father, so I kind of remembered it. But in the commercial it said the burger was only 1 dollar. However I noticed the other day when I entered a local Burger King that it was actually $1.19. Isn't this false advertisement? Not that I'm going to try to sue BK but when you think of the amounts of people who buy whopper jr's everyday thinking their a dollar BK must make millions out of it. I mean supposed with taxes its 1.07, you multiply the the 12 leftover cents by lets say, 1 million burgers a day. That's a lot of money. I just found it amusing and also interesting how such a big industry could make such a stupid error.Isn't this a case of false advertisement.?

Ok, my cousin just got put in jail (I hate to say this but he's white), and I say that because as much as you hate to not hear about it, racism is a HUGE part in the justice system.
But he was out at a friends house, the cops pulled up, and asked him for his SS# and ID and some other stuff, he was drinking, but he was going to stay at his friends house (he's over 21), and he refused to give them his ID...I know the WHOLE story and that is pretty much how it went...and yeah they charged him with ';Voyeurism';, if you don't know what that is: http://en.wikipedia.org/wiki/Voyeurism ... He's going to be on the sex offenders list, and that will make him look like a pervert FOR NO REASON AT ALL!

If you are asked for ID, it's better to give it to an officer.
I don't know why people are so against the police. I'm in training to be an officer, and they don't just go around looking for people to put cuffs on. They need to write 3 hours of reports for one arrest, so they won't do it for fun.

The prosecutor will have to come up with witnesses that were ';being watched'; in a sexual act. If this is a false arrest then he should be found innocent. I would also get an attorney. A public defender will be assigned if he doesn't have the money, but they aren't always so good.
Your cousin is a liar. The police don't just 'show up', they come when called for a valid reason. They also don't demand ID from random people, the demand it from suspects and you're REQUIRED to show it. Additionally, most people who haven't done anything wrong have no problems handing over ID.

When a police officer asks for your information, it is against the law to withhold it. Why, if he is as innocent as he claims, then why the cloak and dagger act? If he's being charged with voyeurism, more than likely, an eyewitness placed him at the scene. If there's no evidence of the crime he's being accused of, I doubt they'd bother trumping one up on a kid. Why would the police bother risking getting in trouble over a kid who simply irritated them? Nasty custody case and false reports. Possible sue for lawyer fees?
I'm going through a bad custody case over my son. I informed the father that I had filed for custody and he will be served with papers soon. That night he called the police stating that my husband abuses the child, burned him with cigarettes, choking, all kinds of horrible stuff. They arrested my husband without any evidence of abuse, but only by what the child said (which was coerced).
My husband went to jail for two weeks until his attorney got him out. After four months, the case was closed and my husband was found not guilty because of lack of evidence.
But during those four months, I was not able to work because my husband is the babysitter of our other child, and he was restricted from being around children unsupervised. The lawyer fees were also very expensive, my husband's name was tarnished, and he went to jail over some petty custody fight he has no part of. I also suffered mental anguish because I couldn't have my son in our home until my husband's court date was over. I could only see my son at his father's house, where I was told in front of my son that my husband is a child abuser and I don't love my son.
Could my husband or I sue them for the false accusations (we have proof they are false), my lost hours at work, mental anguish, the time my husband spent in jail, and his lawyer fees for getting him out of this mess?Nasty custody case and false reports. Possible sue for lawyer fees?

Yes you most certainly can. You can do so with or with out a lawyer. I would advise you to use a lawyer but I know how expensive it can be. Keep track of everything, evidence speaks for itself. Good luck with this it sounds awful. I too have a horrible x husband and he is constantly trying to drag my children through the mud with his brow beating and lies. Men like this make me sick. It is horrendous what they are willing to put children through just to hurt us. I recently went back to court and got his visitation revoked. And he has to pay me back court costs. I had no lawyer but I did have plenty of documentation and evidence so it can be done.

As one who was falsely accused, I think the penalties should be increased. I was lucky that before the charges were filled, the alleged victim recanted. Later the person did the same thing to another person. This put me through a lot of grief, embarrassment and cost me some money. The accuser walked away free of any penalty

this may seem harsh as a female, but a lot of women put themselves into situations that end up badly. if you are a drunk stripper at a party, i find it hard to believe you didnt think about being raped. just because it didnt happen before doesnt mean it wont this time. also, i think a lot of females that cry rape falsely, do it because they feel they were taken advantage of, i.e he wont call after having sex, him treating you like a tramp because you let him have sex so easily...i think the latter is what happened in the kobe bryant case. i feel sorry for the guys at Duke. and i also feel sorry for these girls growing up who arent taught how to handle themselves.

How to file Plea of Alibi (I was elsewhere) in Court in a false dowry case?
I am facing false dowry (498a) case. An incident in the FIR mentioning that I went from my city A to her (bride's) home in another city B and beat her. Where as I have solid proof that at the mentioned time and date I was in my city. Now challan has been filed by the police in the court. Charges are yet to be framed/decided by the court on 30/10/09. Absolutely not. Breaks are not required in switch statements. In fact, you can use multiple switch cases to run the same block of code just by stacking it above each other without breaks. The default case it no different. Filling a false report in abuse case?
I was wondering if anybody knew if i had any legal grounds to get someone on filing a false report.
here is my states statues/laws,

I am asking because my soon to be ex-spouse, filled a report of domestic abuse against me, so she could get temporary emergency custody of our two children, (in which she has a warrant for her arrest for child abuse that the courts failed to see or look for). After i raised hell up in the courthouse the next day as to why she was able to do such a thing, especially with a warrant and since she had not lived in the county that she made the report for more than 6months, they moved my court date up. She failed to appear and all chrages, temporary custody issues and marriage dissolution were dissmissed.
Do I have grounds to file a false report against her, if i have proof that her allegations were false or misleading? ie date of abuse were false etc...Filling a false report in abuse case?
YOu can press charges against her, but I doubt it would do any good. DIvorce cases tend to breed false reports. Several cases each year are filed against fathers for sexual abuse of their children out of vengence. These cases bog down the courts and cost tax payers more money each year.
Though you may have recourse in this matter, I would not pursue it as your soon to be ex wife seems to be posturing for sole custody. It's best to keep things clean on your end. The more reasonable and compromising you appear to a judge, the more likely he/she is to believe you. Judges do not like it when people file false reports especially when the children are the weapon of choice. If you have to go to court over custody, a judge will appreciate that you've tried desparately to keep the peace. You need to document all harassments by your wife and make sure that you ';dot your i's and cross your t's'; and don't get so much as a speeding ticket. Also, make sure you have rooms for your children that are decorated and comfortable for them. This shows more stability. You also need to make sure you talk to their teachers and discuss their progress. This shows you are concerned about the affects your divorce is having and will have on their well being.

If you have proof that can be verified by police or other court officer, yes. But, it has to be verified by someone other than you. I feel very sorry for your children. While you %26amp; she are trying to see who can cause the other the most pain, they are caught in the middle. They are completely innocent. They will be hurt the most because they are innocent. How do I know this? Because my parents did exactly what you %26amp; your wife are doing. I'll be 54 soon. What my parents did to each other %26amp; to me will be with me until the day I die. Both of you need to think about that. What the two of you are doing to each other will haunt your children until the day they die. How important is hurting each other when you think about how your children are suffering, %26amp; will suffer? Good Luck %26amp; Blessings for all of you, AND PRAYERS FOR YOUR CHILDREN.

filing a false police report is a criminal activity not a civil one....filing a false police report falls uner disorderly conduct in the felonies...it is a class 4 felony...if it is proven in court that person lied then charges will be brought on by the pd not you

How to file Plea of Alibi (I was elsewhere) in Court in a false dowry case?
I am facing false dowry (498a) case. An incident in the FIR mentioning that I went from my city A to her (bride's) home in another city B and beat her. Where as I have solid proof that at the mentioned time and date I was in my city. Now challan has been filed by the police in the court. Charges are yet to be framed/decided by the court on 30/10/09. What should I do to stop this false at this initil stage? Should I file Plea of Alibi as (I was elsewhere at the mentioned time and date of the said offence)? What should I do?
