If you signed sight unseeen you are going to have trouble. You didn;t describe what was misleading about the ads, but if there were photos of the apartment that were taken by standing on a ladder in a corner, that is not fraudulent. You need a definite lie of an objective fact in order to make out a claim of fraud. BTW, your remedy is to breach the contract, as you already did. You cannot both abandon the contract and then sue for damages from the breach. You chose your remedy and now the potential fraud is available only as a defense if you get sued, not as grounds for you to sue.
